How we handle copyright claims.
Witness Technologies, Inc. respects intellectual property rights and expects users to do the same. We respond to valid notices of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512.
If you believe that content on Witness infringes your copyright, send a written notice to our designated DMCA agent:

Your notice must include all of the following to be valid:
a. A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
b. A description of the infringing material and its location on Witness, including the specific URL or report ID where the content can be found.
c. Your contact information: full legal name, mailing address, telephone number, and email address.
d. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
e. A statement made under penalty of perjury that the information in your notice is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
f. Your physical or electronic signature.
Incomplete notices will not be processed. Sending a knowingly false DMCA notice may expose you to liability under 17 U.S.C. Section 512(f).
Upon receipt of a valid DMCA notice, we will:
If you believe your content was removed in error, you may file a counter-notice. Your counter-notice must include:
a. Identification of the content that was removed and its location before removal.
b. A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification.
c. Your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or, if outside the United States, any judicial district in which Witness may be found).
d. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a lawsuit seeking a court order to restrain the allegedly infringing activity, we will restore the removed content.
Witness maintains a repeat infringer policy. Accounts that receive three or more valid DMCA notices within any 12-month period will be permanently terminated. This policy is applied at our sole discretion and we reserve the right to terminate accounts with fewer notices in cases of egregious or willful infringement.
By submitting content to Witness, you represent that you own the copyright in the content or have all necessary licenses, rights, consents, and permissions to submit it and to grant Witness the license described in our Terms of Service.
Witness is a citizen journalism platform. Users submitting news footage and eyewitness reports from public events generally have the right to capture and share such content. Witnessing and documenting public events in public spaces is a protected journalistic activity in most jurisdictions. We evaluate DMCA claims about news and documentary content in this context and may decline to remove content where fair use or public interest reporting protections likely apply.
